What happened
The Landlord initially obtained an eviction and arrears order (LTB-L-078421-25) on December 8, 2025, after the Tenant failed to attend the hearing. The Tenant requested a review, claiming he never received the Notice of Hearing due to a postal strike and having moved out of the unit. The LTB granted the review, cancelled the previous order, and held a new hearing. During the new hearing, the Tenant attempted to raise maintenance or rights issues under Section 82, but was barred for failing to provide specific details or the required forms. The LTB found that the Tenant owed significant rent arrears up to the date he vacated the unit.
The ruling
The LTB granted the Tenant's request for a review and cancelled the original eviction order because the Tenant likely did not receive the hearing notice due to a postal strike. However, upon rehearing the case, the LTB found the Tenant owed $6,211.31 in rent arrears and filing fees. The tenancy was officially terminated as of November 11, 2025, the date the Tenant moved out.
