What happened

The Landlord applied for an order to terminate the tenancy for personal use (N12), and for compensation for unpaid utilities and damages. At the hearing, the Tenants' representative requested an adjournment, citing one Tenant's upcoming surgery and the other's unknown whereabouts. The adjournment request was denied. The Landlord withdrew the claim for damages. The Tenants did not contest the Landlord's good faith intention to occupy the unit.

The ruling

The tenancy is terminated, and the Tenants must vacate the rental unit by July 31, 2025. The Tenants are ordered to pay the Landlord $2,723.31 for compensation and unpaid utilities, after deducting the rent deposit and interest. Additionally, the Tenants must pay daily compensation of $90.41 from May 29, 2025, until they move out. The eviction is delayed under section 83 to mitigate unfairness to the Tenants.
