What happened
Landlord applied for an order to terminate the tenancy and evict the Unauthorized Occupant, Angela Cowie, because the Tenant, Donald Martin Cowie, transferred occupancy of the rental unit to her without the Landlord's consent. The Tenant passed away on May 30, 2024, and the Landlord was not given a copy of the death certificate. The Landlord is seeking compensation from the Unauthorized Occupant for the use of the rental unit.
The ruling
The tenancy between the Landlord and Tenant is terminated as of June 29, 2024. The Unauthorized Occupant must vacate the rental unit by October 19, 2024. If the unit is not vacated by that date, the Landlord may file the order with the Court Enforcement Office for enforcement. The Unauthorized Occupant must pay the Landlord $1,169.77 in daily compensation for use of the rental unit and $201.00 in application filing costs by October 19, 2024. If the full amount is not paid by the due date, the Unauthorized Occupant will owe interest at 6.00% on the outstanding balance.
