What happened
The Landlord applied for eviction due to non-payment of rent. A complex history existed where the parties agreed to terminate the tenancy early due to mold concerns, and the Landlord refunded the first and last month's rent ($11,400.00) to the Tenant. The Tenant then refused to vacate and stopped paying rent, claiming an agreement allowed them to stay rent-free until new housing was found. The Landlord disputed this, claiming the refund was contingent on a quick move-out which never happened.
The ruling
The LTB ordered the termination of the tenancy and eviction of the Tenant. To void the order and continue the tenancy, the Tenant must pay $85,686.00 by July 14, 2025, or $91,386.00 by July 25, 2025. If the Tenant does not void the order, they must move out by July 25, 2025, and pay the Landlord $35,186.00 (the jurisdictional cap) plus daily compensation of $187.40 from May 23, 2025, until they vacate.
