What happened
The Tenant filed T1 and T2 applications alleging illegal entry, harassment, and illegal collection of money. The Landlord requested a review of a previous order. The primary issues involved an alleged unauthorized entry for inspection, text messages requesting the Tenant to vacate due to the sale of the property, and the return of the last month's rent deposit after the Tenant moved out.
The ruling
The LTB dismissed the Tenant's claims for illegal entry and harassment but ordered the Landlord to return $1,292.92. This amount covers the remainder of the last month's rent deposit (minus pro-rated rent for the three days in October before the Tenant vacated) and the application filing fee. The Landlord's claim of having already paid $1,000 in cash was rejected for lack of proof.
