What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to their failure to pay utility costs they were required to pay under the terms of the tenancy agreement. The Landlord served a valid N5 notice of termination, but the Tenants did not void the notice by paying the outstanding water bills.

The ruling

The tenancy is terminated effective June 30, 2024 due to the Tenants' failure to pay water bills as required under the tenancy agreement. The Tenants owe the Landlord $2,995.01, which includes the unpaid water bills and the application filing fee, less the rent deposit and interest. If the Tenants do not pay the full amount by June 30, 2024, they will owe interest on the outstanding balance.
