What happened
The Landlord applied to terminate the tenancy based on allegations that the Tenant committed illegal acts, including uttering threats to the superintendent, physical assault, and mischief (vandalizing signage). The Member found that while the allegations of threats and assault were not proven on a balance of probabilities, the Landlord successfully proved two incidents of mischief involving building signage through surveillance evidence.
The ruling
The LTB found the Tenant committed illegal acts of mischief regarding signage but granted relief from eviction. The tenancy continues provided the Tenant refrains from vandalizing the complex or performing unauthorized maintenance. The Tenant is ordered to pay $186.00 to the Landlord for the application filing fee by August 19, 2025.
