What happened

Tenant applied for an order determining that Landlord failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards. The Tenant proved the Landlord required the Tenant to make repairs or replacements to the rental unit as a mandatory condition imposed by the Landlord prior to renewing the Tenant's lease.

The ruling

The Landlord must reimburse the Tenant for the reasonable out-of-pocket expenses incurred by the Tenant as a result of the Landlord failing to maintain the unit pursuant to section 20 of the Residential Tenancies Act, 2006.
