What happened

The Landlord applied to terminate the tenancy and evict the Tenant for non-payment of rent. A central issue was whether a payment made by the Tenant on the same day the application was filed (six minutes prior) voided the N4 notice. The tenancy was terminated effective April 27, 2025, the date the Tenant moved out. After calculating rent arrears and the application fee, and subtracting the payments made since filing along with the rent deposit and accrued interest, the Landlord was ordered to pay the Tenant $489.52 by November 3, 2025.
