What happened

The landlord applied for an order to terminate the tenancy and evict the tenant due to substantial interference with the reasonable enjoyment or lawful right, privilege or interest of the landlord or another tenant. The landlord claimed issues with rabbit feces and urine, people living in the unfinished basement, and a fire caused by a candle left unattended.

The ruling

The tenancy was terminated effective October 31, 2022, the date the tenant vacated the rental unit. The tenant is ordered to pay the landlord $4,745.66 in compensation for use and occupation of the unit from July 1, 2022 to October 31, 2022, less the interest owed on the rent deposit. The tenant is also ordered to pay the landlord $186 for the cost of filing the application.
