What happened

A development company, the Landlord, applied to evict Tenants to demolish the rental unit for a luxury townhome subdivision. The Tenants challenged the application, claiming they were not properly notified of the new ownership and received the N13 notice late. The Landlord provided evidence of ownership notification, development plans, and proper service of the notice. The Board found the Landlord acted in good faith and granted the eviction, but postponed the date to give the Tenants more time to find alternative housing.

The ruling

The tenancy is terminated effective June 30, 2025, as the Landlord proved a good faith intention to demolish the unit. The Tenants must vacate by this date. The Tenants are ordered to pay the Landlord $5,572.93 for use and occupation of the unit after the termination date, plus $77.26 per day until they move out. The eviction date was postponed to provide the Tenants with more time to secure a new rental home.
