What happened

The Landlord applied to evict the Tenant for willfully causing damage by writing graffiti in the parking garage. An initial eviction order was issued. The Tenant requested a review, admitting to the act but asking for relief from eviction. The Tenant cited a relapse from a fentanyl addiction and ongoing recovery efforts. The Landlord consented to the review but opposed relief.

The ruling

The previous eviction order is cancelled. The tenancy is continued on the conditions that the Tenant refrains from causing any further damage to the property and pays the Landlord a total of $434.60 ($248.60 for damages, $186.00 for the application fee) according to a monthly payment plan. If the Tenant fails to meet these conditions, the Landlord may apply to the Board for an eviction order without notice.
