What happened

The Landlord applied to evict the Tenants for non-payment of rent after serving a valid N4 notice. The Tenants were absent from the hearing. The Tenants had been making some payments since the application was filed, but a balance remained outstanding. The member granted a conditional order, allowing the Tenants to void the eviction by paying the arrears by specific dates.

The ruling

The LTB issued a conditional order terminating the tenancy. The Tenants can void the eviction by paying $4,414.12 by April 30, 2025, or $6,394.33 by May 31, 2025. If they fail to pay and do not move out by May 31, 2025, the Landlord can enforce the eviction. If the tenancy is terminated, the Tenants are ordered to pay the Landlord $1,195.18 plus daily compensation of $65.10 from April 9, 2025. The decision to delay eviction was based on the long tenancy and the Tenants' partial payments.
