What happened

The Landlord originally applied for an order to terminate the tenancy after the Tenants allegedly breached a mediated settlement from June 2025. An eviction order was issued without a hearing on October 23, 2025. The Tenants filed a motion to set aside this order. During the hearing for the motion, the parties reached a consent agreement to set aside the eviction order and establish a new payment schedule for the outstanding arrears.

The ruling

The LTB granted the Tenants' motion to set aside a previous eviction order on consent. The parties agreed to a new payment plan where the Tenants will pay $2,737.88 in arrears via monthly installments of $500 starting December 20, 2025, plus a final payment in May 2026. The Tenants must also pay ongoing rent in full and on time. If any payment is missed, the Landlord can apply for an eviction order without further notice.
