What happened

The Landlord applied to terminate the tenancy because the Tenant failed to meet a condition of a previous LTB order. An ex parte order was initially issued. The Tenant subsequently filed a motion to set aside that order. During the hearing for the motion, the parties reached a consent agreement regarding a repayment plan for the accumulated rent arrears.

The ruling

The LTB set aside a previous eviction order and replaced it with a consent order. The Tenant is ordered to pay $6,749.00 in arrears according to a schedule: $150.00 monthly from October 1, 2025, to May 1, 2029, and a final payment of $149.00 on June 1, 2029. The Tenant must also pay current rent in full. Failure to comply with the payment schedule allows the Landlord to apply for an eviction order within 30 days of the breach without notice.
