What happened
The Landlord initially obtained an eviction order for non-payment of rent after a hearing the Tenant did not attend. The Tenant requested a review, claiming she was not properly served the Notice of Hearing, which was sent via text message. The Board granted the review, cancelled the original order, and held a new hearing. In the new hearing, the tenancy was ordered terminated for non-payment of rent, with an option for the Tenant to void the eviction by paying the full arrears.
The ruling
The Tenant's review request is granted, and the previous eviction order is cancelled due to improper service by the Landlord. However, a new order terminates the tenancy unless the Tenant pays $7,186.00 by May 31, 2025, or $8,186.00 by June 13, 2025. If the order is not voided, the Tenant must move out by June 13, 2025, and pay the Landlord $5,909.36 plus daily compensation. The Landlord is ordered to immediately restore possession to the Tenant.
