What happened
The Landlord applied to terminate the tenancy and evict the Tenants because of significant rent arrears and NSF cheque charges. At the hearing, the Landlord and Tenant 2 reached a mutual agreement. They consented to a payment schedule where the Tenants would pay off the arrears in monthly installments while continuing to pay their ongoing rent in full and on time.
The ruling
The Landlord and Tenants entered into a consent agreement. The Tenants are ordered to pay $6,426.00 in arrears and costs through a series of $500.00 monthly installments starting September 15, 2025, with a final payment of $426.00 in September 2026. The Tenants must also pay all future rent when due. If the Tenants miss any payment, the Landlord may apply for an eviction order and the remaining balance without further notice to the Tenants.
