What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant failed to appear at the hearing despite being served. The Landlord served a valid N4 notice which the Tenant did not void. Since the application was filed, the Tenant made a partial payment of $2,700.00. The Landlord's representative requested an extended termination date to allow the Tenant additional time to pay the remaining arrears and void the eviction.
The ruling
The tenancy is terminated effective October 31, 2025, unless the Tenant voids the order. To void the order and continue the tenancy, the Tenant must pay $2,854.00 by October 31, 2025. If the tenancy is terminated, the Tenant is ordered to pay $497.13 to the Landlord, representing arrears and the filing fee minus the rent deposit and interest. Daily compensation of $44.12 applies from October 9, 2025, until the Tenant moves out.
