What happened

The Tenants applied for an order determining that the Landlord collected or retained money illegally by serving them with an N12 Notice to End Tenancy for the Landlord's child to occupy the rental unit, but then later informing the Tenants that the Landlord's child changed their mind and did not want to move in.

The ruling

The Landlord is ordered to pay the Tenants $1,853.00, which includes $1,800.00 for the one month's rent compensation owed under Section 48.1 of the Act, and $53.00 for the cost of filing the application. If the Landlord does not pay the full amount by November 20, 2023, the Landlord will owe interest at 7.00% annually on the outstanding balance.
