What happened

The Landlords applied for an order to terminate the tenancy due to non-payment of rent. An initial order was issued in September 2025, but the Tenants requested a review. Tenant 2 had been hospitalized for approximately 18 months and was unaware of the initial proceedings as Tenant 1 did not inform her to shield her from stress. The LTB granted the review request, cancelled the previous eviction order, and considered a payment plan proposed by the Tenants to save the tenancy for the sake of Tenant 2's health.

The ruling

The LTB granted the review and cancelled the previous eviction order. Although the Tenants owe $27,137.40 in rent arrears and costs, the Board granted relief from eviction conditional on the Tenants adhering to a payment plan. The Tenants must pay a lump sum by December 8, 2025, followed by monthly installments of $1,500.00 toward arrears in addition to regular rent. If any payment is missed, the Landlords may apply for an ex parte eviction order.
