What happened
The Landlord applied for termination of the tenancy and eviction due to non-payment of rent. During the hearing, the Landlord amended the claimed arrears downward. The Tenant disputed the arrears, successfully proving one month's payment, but failed to provide evidence for other periods. The parties ultimately sought a conditional order allowing the Tenant to stay if the remaining balance was paid.
The ruling
The LTB ordered that the tenancy continue provided the Tenant pays $653.61 to the Landlord on or before August 31, 2025. This amount includes rent arrears up to July 31, 2025, and the application filing fee. If the Tenant fails to pay by the deadline, the Landlord may apply for an ex parte order for eviction and the full amount.
