What happened
The Landlords applied for termination and eviction based on rent arrears. The Tenants fell behind after a car accident in December 2024 left them unable to work. Both parties presented evidence of financial hardship; the Landlord had accumulated significant property tax debt and personal loans to maintain the mortgage, while the Tenants were now back at work and proposed a long-term repayment plan. The Adjudicator considered Section 83 relief from eviction.
The ruling
The LTB granted the Tenants relief from eviction on the condition that they adhere to a strict 18-month payment plan to clear $11,486.00 in arrears. The plan starts at $500/month and escalates to $836/month by December 2026. The Tenants must also pay current rent in full and on time. Failure to meet any payment allows the Landlord to apply for an immediate eviction order without further notice to the Tenants.
