What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant because the Tenant, another occupant of the rental unit or a person the Tenant permitted in the residential complex has seriously impaired the safety of any person and the act or omission occurred in the residential complex. The Landlord alleged that the rental unit was kept in an extremely unclean state, affecting the health and safety of neighboring rental units.

The ruling

The Landlord has proven on a balance of probabilities the grounds for termination of the tenancy due to the Tenant's failure to maintain the rental unit in a reasonable state of cleanliness, which has seriously impaired the safety of neighboring tenants. The tenancy is terminated effective January 31, 2024. The Landlord owes the Tenant $870.96 for the rent deposit and interest.
