What happened

The Tenant filed an application against the Landlord for illegal entry and substantial interference. The Landlord entered the rental unit on two consecutive days at the end of the tenancy without providing the required 24-hour written notice. The Tenant and her witness found the Landlord in the unit, believing he had stayed overnight and slept in her bed, which caused the Tenant distress.

The ruling

The Board ordered the Landlord to pay the Tenant $200.50, comprising a $152.50 rent abatement and the $48.00 application fee. This decision stemmed from findings that the Landlord entered the unit illegally without proper notice and substantially interfered with the Tenant's enjoyment, which included conduct leading the Board to find it more likely than not that he had slept in the Tenant's bed.
