What happened

The Landlord applied to terminate the tenancy because the Tenants allegedly breached conditions of a previous LTB order. An order (LTB-L-036506-25) was issued without a hearing on May 14, 2025. The Tenants filed a motion to set aside that order. However, prior to the hearing for the motion, the Tenants vacated the unit following separate enforcement proceedings. Because the Tenants were no longer in possession and did not seek to return, the motion was deemed moot and subsequently withdrawn.

The ruling

The motion to set aside the eviction order was withdrawn as it became moot after the Tenants vacated the property. The stay on the May 14, 2025, eviction order is lifted immediately, confirming the termination of the tenancy.
