What happened

The Landlord applied to terminate the tenancy and evict an unauthorized occupant after the Tenant mutually agreed to terminate the lease but left an occupant behind. The Tenant moved out in December 2024 and signed an N11 agreement. However, an Unauthorized Occupant remained in the unit, refused to leave, and failed to pay any compensation for six months. The Landlord also raised concerns regarding fire hazards and the condition of the unit.

The ruling

The LTB ordered the termination of the tenancy and the eviction of the Unauthorized Occupant and any other residents by July 8, 2025. The Unauthorized Occupant is ordered to pay $9,941.40 in compensation plus daily charges until moving out. Both the Tenant and the Unauthorized Occupant are jointly liable for the $201.00 application fee.
