What happened
The Tenant filed a T6 application, alleging the Landlord failed to meet maintenance obligations concerning the stove in the rental unit. The Tenant claimed a power-on indicator light remained constantly on, raising safety concerns. The Landlord contended they responded to the initial notification but received no follow-up from the Tenant, leading them to believe the issue was resolved. The Landlord also suggested the application was filed in retaliation for a previous, successful eviction proceeding. The tenancy had already terminated on June 30, 2024, following that eviction order.
The ruling
The Tenant's T6 application concerning the Landlord's alleged failure to meet maintenance obligations for the stove is dismissed. The Board found the stove was functional and the Landlord acted reasonably. The Tenant failed to prove a breach of the Act on a balance of probabilities.
