What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Landlord served the Tenant with an invalid N4 notice, so the Landlord elected to pursue an arrears only order. The parties disagreed on the lawful rent amount and the Tenant was still in possession of the rental unit at the time of the hearing.

The ruling

The Landlord's first and second rent increases were void, so the lawful rent remained at $720 per month. The Tenant owes $10,080 in rent arrears from January 2024 to February 2025, plus the $186 filing fee, for a total of $10,266 owed to the Landlord. If the Tenant does not pay the full amount by March 4, 2025, they will owe interest at 5% annually on the outstanding balance.
