What happened

The landlord applied to terminate the tenancy and evict the tenants because the landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year by the landlord's daughter.

The ruling

The landlord's N12 notice is invalid as the termination date is not at the end of the rental period as required by the Act. The landlord's application is dismissed and the tenant must pay back the $3,250 compensation paid by the landlord.
