What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year for himself, his fiancé and four children.

The ruling

The tenancy is terminated effective June 20, 2023. The Landlord is required to re-issue a cheque to the Tenant for $791.18 by April 30, 2023. The Landlord is authorized to deduct from the amount owing to the Tenant for last month's rent and compensation for the Tenant's use of the unit starting February 7, 2023 to the date the Tenant moves out.
