What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.
The ruling
The Landlord's N4 Notice was found to be defective due to the improper rent increase. The Landlord amended the application to an L9 application for arrears only. The Tenants are ordered to pay the Landlord $3,186.00 in rent arrears and application filing costs by September 2, 2024. If the Tenants do not pay, they will owe interest at 7% annually on the outstanding balance starting September 3, 2024.
