What happened

The Landlord applied to terminate the tenancy and evict the Tenant due to significant rent arrears. The Tenant, a long-term resident on a fixed income, faced financial hardship due to his spouse's health issues. While the Landlord sought immediate eviction citing financial pressure and personal status (not a commercial landlord), the Member granted relief from eviction subject to a strict 24-month payment plan to preserve the tenancy and prevent homelessness.

The ruling

The Tenant is ordered to pay the total amount of $12,166.00. However, eviction is stayed provided the Tenant adheres to a payment plan of $500.00 per month towards arrears, plus the regular monthly rent, starting August 1, 2025. If any payment is missed, the Landlord may apply for an immediate eviction order without notice under section 78.
