What happened
The Landlord applied for rent arrears and termination of the tenancy. However, during the hearing, the Landlord admitted to refusing rent payments from the Tenants due to a separate dispute. As a result, the Board found the N4 notice defective for termination purposes but allowed the application to proceed regarding the collection of undisputed arrears.
The ruling
The tenancy is not terminated. The Tenants are ordered to pay $6,357.00 in rent arrears to the Landlord by December 30, 2025. The request for eviction was dismissed because the Landlord admitted to refusing rent payments, which made the legal notice invalid for termination. The Landlord was also denied the application fee because their refusal to accept rent directly led to the legal dispute.
