What happened

The Landlord applied for eviction and rent arrears following the Tenant's failure to meet conditions in a previous Board order. After an eviction order was issued and a motion to set it aside was resolved, the Tenant requested a review of that resolution. The Tenant claimed they missed the hearing because they forgot to log back into the proceedings after being stood down for a medical appointment. The Board conducted a preliminary review to determine if a serious error occurred or if the Tenant was denied a reasonable opportunity to participate.

The ruling

The Tenant's request for a review of the order dated November 27, 2025, is denied. The Board found that the Tenant's failure to rejoin the hearing after a scheduled break for a medical appointment was due to personal forgetfulness rather than a lack of opportunity to participate. Consequently, the previous order remains confirmed and unchanged.
