What happened

The Tenant applied for the return of a $1,000.00 last month's rent deposit, claiming the Landlord agreed to terminate the fixed-term tenancy early on February 1, 2025. The Landlord denied an unconditional agreement to terminate on that date, stating he only agreed to end it early if a new tenant was found. The Landlord rented the unit starting February 17, 2025, and argued he was entitled to keep the rent deposit up to that date.

The ruling

The Landlord is ordered to pay the Tenant $394.50 by November 2, 2025. This amount represents the pro-rated refund of the last month's rent deposit for the period of February 17 to February 28, 2025, during which the Landlord had already secured a new occupant.
