What happened

Landlords applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was still in possession of the rental unit at the time of the hearing.

The ruling

The Landlords' application to terminate the tenancy and evict the Tenant for non-payment of rent was granted. The Tenant can void the order by paying $55,241 by February 28, 2025 or $62,071 by March 3, 2025. If the Tenant does not void the order, the tenancy will be terminated, and the Tenant must vacate the unit by March 3, 2025. The Landlords were ordered to repair the damaged hardwood floors within 60 days, and a rent abatement of $6,415 was granted to the Tenant for the maintenance issues.
