ON K1K2H3 Between: O.C.H. Landlord And M.M.P. Tenant O.C.H. (the 'Landlord') applied for an order to terminate the tenancy and evict M.M.P. (the 'Tenant') because the Tenant did not pay the rent that the Tenant owes. This application was heard by videoconference on April 26, 2023. Only the Tenant attended the hearing. As of 9:38 AM the Landlord was not present or represented at the hearing. Determinations: 1. Prior to the hearing, the Landlord's Legal Representative contacted the Landlord Tenant Board (the ‘LTB’) and requested to withdraw the matter, as the Tenant had paid all of her arrears. 2. This request was not addressed before the hearing, therefore, the hearing proceeded. 3. Since the Landlord did not attend the hearing to address its application, I find that the Landlord effectively withdrew the application by abandoning it. It is ordered that: 1.
