Mantler Management Ltd (the 'Landlord') applied for an order to terminate the tenancy and evict
S.Z. (the 'Tenant') because the Tenant did not pay the rent that the Tenant owes.
The Landlord's application was resolved by order TNL-25940-20, issued on January 22, 2021.
The Landlord applied for an eviction order, alleging that the Tenant breached the order
TNL25940-20, issued on January 22, 2021.
The Landlord’s application was resolved by order TNL-006367-23, issued on March 29, 2023.
This order was issued without a hearing being held.
The Tenant filed a motion to set aside order LTB-L-006367-23, issued on March 29, 2023.
The motion was heard by videoconference on April 24, 2023.
The Landlord’s legal representative, B. Burd, the Landlord’s agent, D. Bowman, and the Tenant
attended the hearing.
At the hearing, the parties consented to the following order. I was satisfied that the parties
understood the consequences of their consent.
On consent, it is ordered that:
1. The motion to set aside Order LTB-L-006367-23, issued on January 22, 2021, is granted.
2. Order LTB-L-006367-23, issued on January 22, 2021, is set aside and cannot be enforced.
It is replaced by the following order.

3. The monthly rent is $1,246.00, due on the first day of each month.
4. The Tenant shall pay the $6.563.00 arrears and costs owing to the Landlord to April 30,
2023, as follows:
(a) $400.00 on or before April 24, 2023,
(b) Commencing May 2023, and continuing each month for 30 months, up to and
including October 2025, $200.00 on or before the 15th day of each of those months,
respectively,
(c) $163.00 on or before November 15, 2025.
5. Commencing May 2023, and continuing each month up to and including November 2025,
the Tenant shall pay the rent, in full, no later than the first day of each of those months,
respectively.
6. If the Tenant fails to comply with the conditions set out in paragraphs 4 and 5 of this order,
the Landlord may apply under section 78 of the Residential Tenancies Act, 2006 (the ‘Act')
for an order terminating the tenancy and evicting the Tenant. The Landlord must make the
application within 30 days of a breach of a condition. This application is made to the LTB
without notice to the Tenant.
