(the 'Landlord') applied for an order to terminate the tenancy and evict Abdul Jaleel Raisan Kadhem (the 'Tenant') because: • the Tenant, another occupant of the rental unit or someone the Tenant permitted in the residential complex has substantially interfered with the reasonable enjoyment or lawful right, privilege or interest of the Landlord or another tenant; • the Tenant, another occupant of the rental unit or someone the Tenant permitted in the residential complex has wilfully or negligently caused damage to the premises. This application was resolved by order LTB-L-007211-22 issued on November 21, 2022. Only the Landlord’s Legal Representative, G. Gosling attended the hearing on November 21, 2023. On January 4 2023, the Tenant requested a review of the order and that the order be stayed until the request to review the order is resolved. On January 4, 2023 interim order LTB-L-007211-22-RV-IN was issued, staying the order issued on November 21, 2022. This application was heard in by videoconference on June 7, 2023. The Landlord and the Tenant attended the hearing. Determinations: 1. The Tenant moved out of the rental unit and requested to withdraw the request to review. The interim order issued on January 4, 2023 is cancelled.
