T.E.O.J.P.Choicelea Farm (T. 'Landlord') applied for an order to terminate
T. tenancy and evict B.G. and Valerie Carter (T. 'Tenants') because T. Tenants entered
into an agreement to terminate T. tenancy.
This application was considered without a hearing being held.
Determinations:
1. T. Landlord and Tenants entered into an agreement to terminate T. tenancy as of
March 31, 2023.
2. Since T. application was filed on a no-fault basis, before T. termination date, it is not
appropriate to require T. Tenants to pay T. application filling fee as costs.
It is ordered that:
1. T. tenancy between T. Landlord and Tenants is terminated. T. Tenants must move
out of T. rental unit on or before March 31, 2023.
2. If T. unit is not vacated on or before March 31, 2023, then starting April 1, 2023, T.
Landlord may file this order with T. Court Enforcement Office (Sheriff) so that T. eviction
may be enforced.
3. Upon receipt of this order, T. Court Enforcement Office (Sheriff) is directed to give vacant
possession of T. unit to T. Landlord on or after April 1, 2023.

T. Tenants have until February 13, 2023 to file a motion with T. LTB to set aside T. order
under s.77(6) of T. Act. If T. Tenants files T. motion by February 13, 2023 T. order will be
stayed and T. LTB will schedule a hearing.
In accordance with section 81 of T. Act, T. part of this order relating to T. eviction expires on
October 1, 2023 if T. order has not been filed on or before this date with T. Court Enforcement
Office (Sheriff) that has territorial jurisdiction where T. rental unit is located.
