Order under Section 69 2023 ONLTB 32072 (CanLII) Residential Tenancies Act, 2006 Citation: W. v A., 2023 ONLTB 32072 Date: 2023-04-20 File Number: LTB-L-008548-23 In the matter of: Main Floor-1437 Westbrook Drive Peterborough, ON K9J 6R3 Between: C.W. Landlord And A.A. Tenant C.W. (the 'Landlord') applied for an order to terminate the tenancy and evict A. A. (the 'Tenant') because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year. The Landlord also claimed compensation for each day the Tenant remained in the unit after the termination date. This application was heard by videoconference on April 6, 2023. The Landlord, the Landlord’s Legal Representative Carrie Aylwin, the Tenant and the Tenant’s Legal Representative Crystal Francey attended the hearing. Before the LTB the parties agreed to the following consent order. It is ordered that: 1. The tenancy between the Landlord and the Tenant is terminated. The Tenant must move out of the rental unit on or before August 31, 2023. 2. If the unit is not vacated on or before August 31, 2023, then starting September 1, 2023, the Landlord may file this order with the Court Enforcement Office (Sheriff) so that the eviction may be enforced. 3. Upon receipt of this order, the Court Enforcement Office (Sheriff) is directed to give vacant possession of the unit to the Landlord on or after September 1, 2023. 4. The Tenant’s last month rent deposit of $1,200.00 shall be applied to the month of August 2023. 5. The Landlord shall pay to the Tenant $65.00 to top up the interest owing on the last month’s rent deposit. 6. The parties agree that the Tenant may vacate the unit on 10 days notice to the Landlord if 2023 ONLTB 32072 (CanLII) she is able to find a suitable unit prior to August 31, 2023.
