In the matter of: 107, 240 LAKE PROMENADE ETOBICOKE
ON M8W1B2
Between: Lake Promenade Apartments Limited Landlord
And
Robert Wade Tenant
Review Order
Lake Promenade Apartments Limited (the 'Landlord') applied for an order to terminate the
tenancy and evict Robert Wade (the 'Tenant') because the Tenant did not pay the rent that the
Tenant owes.
This application came before the Board on November 9, 2022. The Landlord did not attend the
hearing and the Landlord’s application was dismissed by order LTB-L-022998-22 issued on
December 8, 2022.
On December 13, 2022, the Landlord requested a review of the order.
The Landlord’s request to review was heard by videoconference on January 10, 2023.
Only the Landlord’s legal representative, Howard Levenson, attended the hearing.
Throughout the entire hearing block, the Tenant was not present or represented at the hearing
although properly served with notice of this hearing by the LTB. There was no record of a request
to adjourn the hearing. As a result, the hearing proceeded with only the Landlord's evidence.
Determinations:

File Number: LTB-L-022998-22-RV
Request to review:
1. Based on the uncontested evidence before me, I am satisfied that the Landlord was not
reasonably able to participate in the proceeding because neither the Landlord, nor the
Landlord’s legal representative, received the Notice of Hearing.
2023 ONLTB 15443 (CanLII)
2. As such, the Landlord’s request to review was granted and the Landlord’s application was
heard de novo.
L1 application:
3. The Landlord served the Tenant with a valid Notice to End Tenancy Early for Non-payment
of Rent (N4 Notice). The Tenant did not void the notice by paying the amount of rent
arrears owing by the termination date in the N4 Notice or before the date the application
was filed.
4. As of the hearing date, the Tenant was still in possession of the rental unit.
5. The lawful rent is $1,710.00. It is due on the 1st day of each month.
6. Based on the Monthly rent, the daily rent/compensation is $56.22. This amount is
calculated as follows: $1,710.00 x 12, divided by 365 days.
7. The Tenant has not made any payments since the application was filed.
8. The rent arrears owing to January 31, 2023 are $15,695.00.
9. The Landlord is entitled to $200.00 to reimburse the Landlord for administration charges
and $50.00 for bank fees the Landlord incurred as a result of 10 cheques given by or on
behalf of the Tenant which were returned NSF.
10. The Landlord incurred costs of $186.00 for filing the application and is entitled to
reimbursement of those costs.
11. The Landlord collected a rent deposit of $1,710.00 from the Tenant and this deposit is still
being held by the Landlord. The rent deposit can only be applied to the last rental period of
the tenancy if the tenancy is terminated.
12. Interest on the rent deposit, in the amount of $40.29 is owing to the Tenant for the period
from February 1, 2022 to January 10, 2023.
13. I have considered all of the disclosed circumstances in accordance with subsection 83(2)
of the Residential Tenancies Act, 2006 (the 'Act'), including the impact of COVID-19 on the
parties and whether the Landlord attempted to negotiate a repayment agreement with the
Tenant, and find that it would be unfair to grant relief from eviction pursuant to subsection
83(1) of the Act.
It is ordered that:
