S.L. (the 'Landlord') applied for an order to terminate the tenancy and evict J.
Burnett-lee (the 'Tenant') and for an order to have the Tenant pay the rent they owe because the
Tenant did not meet a condition specified in the order issued by the LTB on March 14, 2023 with
respect to application LTB-L-039734-22.
The Landlord's application was resolved by order LTB-L-026186-23, issued on March 14, 2023.
This order was issued without a hearing being held.
The Tenant filed a motion to set aside order LTB-L-026186-23.
The motion was heard by videoconference on June 7, 2023. The Landlord’s representative Maria
Ceglie, and the Tenant, attended the hearing.
The Tenant plans to vacate the unit and informed the Board and the Landlord’s representative
that he wants to work out a payment plan to resolve the outstanding arrears. The Tenant does
not disagree with the contents of order LTB-L-026186-23.
It is ordered that:
1. The motion to set aside Order LTB-L-026186-23, issued on March 14, 2023, is denied.
2. The stay of Order LTB-L-026186-23, is lifted immediately.
3. Order LTB-L-026186-23 is unchanged.
