2023 ONLTB 37559 (CanLII)
Residential Tenancies Act, 2006
Citation: Frastell Property Management Inc v Yu, 2023 ONLTB 37559
Date: 2023-05-15
File Number: LTB-L-032778-23
In the matter of: 606, 465 RICHMOND RD
OTTAWA ON K2A1Z1
Between: Frastell Property Management Inc Landlord
And
G.G.Y. Tenant
Frastell Property Management Inc (the 'Landlord') applied for an order to terminate the tenancy
and evict G.G.Y. (the 'Tenant') because the Tenant entered into an agreement to
terminate the tenancy.
This application was considered without a hearing being held.
Determinations:
1. The Landlord and Tenant entered into an agreement to terminate the tenancy as of July
31, 2023.
2. Since the application was filed on a no-fault basis, before the termination date, it is not
appropriate to require the Tenant to pay the application filling fee as costs.
It is ordered that:
1. The tenancy between the Landlord and Tenant is terminated. The Tenant must move out of
the rental unit on or before July 31, 2023.
2. If the unit is not vacated on or before July 31, 2023, then starting August 1, 2023, the
Landlord may file this order with the Court Enforcement Office (Sheriff) so that the eviction
may be enforced.
3. Upon receipt of this order, the Court Enforcement Office (Sheriff) is directed to give vacant
possession of the unit to the Landlord on or after August 1, 2023.
