Order under Section 16.1 of the 2023 ONLTB 34168 (CanLII) Statutory Powers Procedure Act and the Residential Tenancies Act, 2006 Citation: T.C.H.C. v Rodrigues, 2023 ONLTB 34168 Date: 2023-05-03 File Number: LTB-L-037517-22-IN In the matter of: 406, 1525 DUNDAS ST W T. ON M6K1T7 Between: T.C.H.C. Landlord And Maria Rodrigues Tenant T.C.H.C. (the 'Landlord') applied for an order to terminate the tenancy and evict Maria Rodrigues (the 'Tenant') because the Tenant did not pay the rent that the Tenant owes. This application was heard by videoconference on March 28, 2023. The Landlord attended the hearing and was represented by Camille Abraham. The Tenant attended the hearing and was assisted by her son, Joshua Rodrigues. Determinations: 1. The application was adjourned to provide the Tenant with time to give documentation to the Landlord that is needed to process the Tenant’s rent subsidy. 2. The parties agreed that the Tenant will pay to the Landlord $434.00 per month, beginning April 1, 2023, until a final order has been issued by the Board. It is ordered that: 1. The hearing is adjourned peremptory on the Tenant at a date to be scheduled by the Board. 2. The Tenant shall pay to the Landlord $434.00 representing the monthly rent, on or before the first of each month beginning on April 1, 2023 and shall continue to do so until the application has been heard and a final order rendered by the Board on the application. The monies paid will be accounted for when the final order is rendered by the Board. 3. If the Tenant fails to make any one of the payments in accordance with this order, the Landlord may request that the L1 application is rescheduled as soon as possible. The Landlord and the Tenant shall serve on the other party, and file with the Board via email, a copy of any recording, document, receipts, photograph or like thing they intend to rely on at the hearing at least 7 days before the hearing date set out in the notice of hearing. 5. Pursuant to Rule 19.7 of the Board’s Rules of Procedure a party who fails to comply with an order for disclosure may not be permitted to rely on evidence that is not disclosed as ordered.
