Order under Section 21.2 of the Statutory Powers Procedure Act and the Residential Tenancies Act, 2006 2023 ONLTB 27326 (CanLII) Citation: Havcare Investments Inc v Mason, 2023 ONLTB 27326 Date: 2023-03-16 File Number: LTB-L-037627-22-RV In the matter of: 210, 500 DAWES RD Toronto ON M4B2G1 Between: Havcare Investments Inc Landlord And Ricardo Mason Tenant Review Order Havcare Investments Inc (the 'Landlord') applied for an order to terminate the tenancy and evict Ricardo Mason (the 'Tenant') because the Tenant did not pay the rent that the Tenant owes. The Landlord also claimed charges related to NSF cheques. This application was resolved by consent Board order LTB-L-037627-22, issued on February 23, 2023. On March 13, 2023, the Tenant requested a review of the order. A preliminary review of the review request was completed without a hearing. Determinations: 1. I have listened to the February 13, 2023 hearing recording, and I have reviewed the Board’s application record. On the basis of the submissions made in the request, I am not satisfied that there is a serious error in the consent order, or that a serious error occurred in the proceedings. 2. The February 13, 2023 hearing recording confirms that the parties consented to the terms of the February 23, 2023 Board order. Order Page 1 out of 2 3. The Tenant submits in this review request that “The order included a remedy that is not appropriate in the circumstances at this time”, without further detail. 4. I find that the Tenant’s submission does not describe a serious error in the order, or a 2023 ONLTB 27326 (CanLII) serious procedural error. The Tenant’s request to review the February 23, 2023 order must in the circumstances be denied. It is ordered that: 1. The request to review order LTB-L-037627-22, issued on February 23, 2023, is denied. The order is confirmed and remains unchanged.
