Review Order
K.F.H.C. (the 'Landlord') applied for an order to terminate the
tenancy and evict Sarena Graham (the 'Tenant') because the Tenant did not pay the rent that the
Tenant owes.
This application was resolved by order LTB-L-039611-22 issued on March 6, 2023.
On April 4, 2023, the Tenant requested a review of the order and that the order be stayed until
the request to review the order is resolved.
On April 11, 2023, interim order LTB-L-039611-22-RV-IN was issued, staying the order issued
on March 6, 2023
This application was heard in by videoconference on April 24, 2023.
The Landlord’s representative, Nicola Diak, the Tenant and the Tenant’s legal representative,
William Florence, attended the hearing.
At the hearing, the parties agreed that the Tenant would withdraw their request to review and that
the Landlord would be permitted to enter the rental unit immediately to dispose of unhygienic
items and treat the unit for pests.
The parties contested the date the stay should be lifted. The Landlord requested that the stay be
lifted as soon as possible while the Tenant sought a delay so that they could have time to remove
their belongings from the rental unit. I find it appropriate in this case to provide a minor delay in
the lifting of the stay to give the Tenant the opportunity to remove their belongings.

It is ordered that:
1. The request to review order LTB-L-039611-22 issued on March 6, 2023 is withdrawn. The
order is confirmed and remains unchanged.

2. The interim order issued on April 11, 2023 is cancelled. The stay of order LTB-L-039611-
22 is lifted on May 6, 2023.
3. The Landlord may enter the rental unit to remove unhygienic items and treat the unit for
pests.
