Landlord And J.O. Tenant Park Property Management Inc. (the 'Landlord') applied for an order to terminate the tenancy and evict J.O. (the 'Tenant') and for an order to have the Tenant pay the rent they owe because the Tenant did not meet a condition specified in the mediated settlement signed by the parties on May 18, 2023 with respect to application LTB-L-063682-22. The Landlord’s application was resolved by order LTB-L-041841-23, issued on June 16, 2023. The Tenant filed a motion to set aside order LTB-L-041841-23 on June 23, 2023. This motion was heard by videoconference on August 2, 2023. The Tenant and the Landlord’s Legal Representative Anita Sada attended the hearing. At the hearing, the parties consented to the following order. Determinations: 1. The parties agreed to delay lifting the stay of the order to August 21, 2023 wherein the Tenant intends on satisfying the totality of the arrears by that date. It is ordered that: 1. The motion to set aside order LTB-L-041841-23, issued on June 23, 2023, is denied. 2. The stay of order LTB-L-041841-23 will remain in force until August 21, 2023 after which the order may be enforced.
