Oct 16, 2024 Order under Section 69 Adam Rogers Residential Tenancies Act, 2006 File Number: LTB-L-058455-24 In the matter of: 640 Crevier Walk Ottawa ON K1W0N5 Between: Y.S. Landlord Thomas Budnick And C.M. Tenant Y.S. and Thomas Budnick (the 'Landlord') applied for an order to terminate the tenancy and evict C.M. (the 'Tenant') because the Tenant did not pay the rent that the Tenant owes. The application was scheduled to be heard by video conference on October 7, 2024. As a result of this order, the hearing has been cancelled. Prior to the hearing, the parties elected to participate in LTB facilitated mediation with the assistance of a Dispute Resolution Officer. The Landlords, the Tenant, and Tenant Duty Counsel Christelle Azzi attended the mediation. When the capitalized word “Landlord” is used in this order, it refers to all persons or companies identified as a Landlord at the top of the order. When the capitalized word “Tenant” is used in this order, it refers to all persons identified as a Tenant at the top of the order. The Parties agreed that: 1. The Landlord served the Tenant with a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice). The Tenant did not void the notice by paying the amount of rent arrears owing by the termination date in the N4 Notice or before the date the application was filed. 2. The Tenant was in possession of the rental unit on the date the application was filed. 3. The Tenant vacated the rental unit on September 19, 2024. 4. The rent arrears owing to September 19, 2024, are $5,538.48 inclusive of the $186.00 filing fee. 5. The Landlord collected a rent deposit of $2,200.00 from the Tenant and that deposit and accrued interest were applied to the rental period beginning September 01, 2024. The tenancy between the Landlord and the Tenant is terminated as of September 19, 2024, the date the Tenant moved out of the rental unit. 2. The Tenant shall pay to the Landlord $5,538.48. This amount includes rent arrears up to the date the Tenant moved out of the rental unit, inclusive of the $186,00 filing fee. 3. The Landlord shall waive enforcement of the interest on the arrears, providing the Tenant’s complies with the payments schedule contemplated in paragraph 4. 4. The Tenant shall pay the Landlord the amount owing in paragraph 2 as follows: • $50.00 on or before November 15, 2024; • $50.00 on or before December 15, 2024; • $250.00 on or before January 15, 2025; • $250.00 on or before February 15, 2025; • $250.00 on or before March 15, 2025; • $250.00 on or before April 15, 2025; • $250.00 on or before May 15, 2025; • $250.00 on or before June 15, 2025; • $250.00 on or before July 15, 2025; • $250.00 on or before August 15, 2025; • $250.00 on or before September 15, 2025; • $250.00 on or before October 15, 2025; • $250.00 on or before November 15, 2025; • $250.00 on or before December 15, 2025; • $250.00 on or before January 15, 2026; • $250.00 on or before February 15, 2026; • $250.00 on or before March 15, 2026; • $250.00 on or before April 15, 2026; • $250.00 on or before May 15, 2026; • $250.00 on or before June 15, 2026; • $250.00 on or before July 15, 2026; • $250.00 on or before August 15, 2026; • $250.00 on or before September 15, 2026; and, • $188.48 on or before October 15, 2026. This will be simple interest calculated from November 15, 2024, at 6.00% annually on the balance outstanding.
