O. C. A. R. C. (the 'L.') applied for an order to terminate the tenancy
A. evict J. E. S. (the 'Tenant') because the Tenant did not pay the rent that the
Tenant owes.
This application was heard by videoconference on April 25, 2023. The Landlord, O. C., the
L.’ legal representative, K. Hawkes, A. the Tenant attended the hearing. I am satisfied
the parties understood the consequences of the following joint submissions.
On consent, it is ordered that:
1. The Tenant shall pay to the Landlord $15,786.00, which represents the arrears of rent A.
the application filing fee outstanding for the period ending April 30, 2023.
2. The Tenant shall pay M. 2023 rent on or before M. 19, 2023.
3. If the Tenant does not pay the L. the full amount owing on or before M. 19, 2023,
the Tenant will start to owe interest. This will be simple interest calculated from M. 20,
2023 at 6.00% annually on the balance outstanding.
4. The tenancy between the L. A. the Tenant is terminated on M. 31, 2023.
5. If the unit is not vacated on or before M. 31, 2023, then starting June 1, 2023, the
L. M. file this order with the Court Enforcement Office (Sheriff) so that the
eviction M. be enforced.
6. Upon receipt of this order, the Court Enforcement Office (Sheriff) is directed to give vacant
possession of the unit to the L. on or after June 1, 2023.
